Welcome to findacleaner.net (“we,” “our,” or “us”). These Terms of Use (“Terms”) outline the rules and guidelines for using our platform, which connects cleaning professionals (“Cleaners”) with individuals or businesses seeking cleaning services (“Clients”).

By accessing or using findacleaner.net (the “Platform”), you agree to comply with these Terms. If you disagree with any part, you must not use our Platform.

1. About Our Platform

findacleaner.net is an online platform that connects Cleaners with Clients seeking cleaning services. We facilitate payment processing through Stripe but do not directly provide cleaning services. All cleaning services are performed independently by Cleaners.

2. Disclaimer

– Platform Role:
findacleaner.net provides an online platform to connect Clients seeking cleaning services with independent Cleaners. We are a facilitator, not a party to service agreements between Clients and Cleaners.

– No Employment Relationship:
Cleaners listed on our Platform are independent contractors and not employees, agents, or representatives of findacleaner.net. We do not supervise, direct, or control the services provided by Cleaners.

– No Guarantee of Services:
We make no representations or guarantees regarding:

• The quality, reliability, or suitability of any Cleaner or service.
• The accuracy or truthfulness of Cleaner profiles or Client requests.

– Payment Processing:
While payments are processed through our Platform via Stripe:

• We act as an intermediary to facilitate payment transactions between Clients and Cleaners.
• Once the payment is processed, we deduct a service fee (15-20%) and transfer the remaining amount to the Cleaner.
• We are not responsible for any payment disputes or delays caused by Stripe.

– User Responsibility:

• Clients are solely responsible for verifying the qualifications, licenses, insurance, and background of Cleaners.
• Cleaners are responsible for ensuring their services comply with all applicable laws and regulations.

– Limited Liability:
To the fullest extent permitted by law:

• findacleaner.net is not liable for any harm, injury, loss, or damages arising from the use of our Platform or services facilitated through it.
• Our liability, if any, is limited to the amount of fees we collect from the affected transaction.

– No Warranties:
The Platform is provided on an “as-is” and “as-available” basis without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

– Third-Party Issues:
Any disputes, damages, or claims arising from the services provided by a Cleaner or requested by a Client are the sole responsibility of the parties involved. findacleaner.net is not liable for any issues related to:

• Service quality or completion.
• Cancellations or rescheduling.
• Miscommunication or misunderstanding between Clients and Cleaners.

– Force Majeure:
We are not liable for any failure or delay in performance due to causes beyond our control, including but not limited to natural disasters, strikes, government actions, or internet outages.

3. User Responsibilities

3.1 Clients

• Provide accurate information when posting job requests.
• Ensure timely payments through the Platform for booked services.
• Communicate job details clearly with Cleaners.

3.2 Cleaners

• Maintain professionalism, quality of work, and compliance with applicable laws.
• Provide accurate profile details, including qualifications and service descriptions.
• Deliver agreed-upon services to Clients and resolve any complaints promptly.

3.3 General User Conduct

All users agree:

• Not to engage in illegal, abusive, or fraudulent activities.
• Not to post misleading information or harass other users.
• To comply with all applicable laws and regulations.

4. Payment Process

• Client Payments: Payments for cleaning services are processed securely through Stripe on our Platform.
• Commission: We deduct a service fee (15-20% of the total amount) from the payment before transferring the remainder to the Cleaner.
• Cleaner Payments: After deducting our commission, Stripe processes the payment and deposits the remaining amount directly into the Cleaner’s bank account.
• Tax Compliance: All users are responsible for their own tax obligations. Cleaners must include any applicable taxes in their pricing.

5. Subscription Terms

• Subscriptions for Cleaners: Cleaners may subscribe to access premium features, such as additional job leads or profile boosts.
• Billing: Subscriptions are billed on a recurring basis (monthly, quarterly, or annually), depending on the plan chosen.
• Cancellation:
  • Subscriptions can be canceled anytime through account settings.
  • Upon cancellation, premium features remain active until the end of the current billing cycle. No refunds are provided for unused portions unless required by law.

6. Cancellation Policy

For Clients:

• If a Client cancels a booking:
  • Cancellations more than 24 hours before the scheduled service time may not incur charges unless otherwise stated.
  • Cancellations within 24 hours may result in a cancellation fee equivalent to a percentage of the total service price, as specified in the booking terms.

For Cleaners:

• If a Cleaner cancels a booking, they must notify the Client promptly. Repeated cancellations without valid reasons may result in account suspension or termination.

7. Dispute Resolution

We encourage Clients and Cleaners to resolve disputes directly. If a resolution cannot be reached:

• Reporting a Dispute: Users may report disputes through our Platform for review.
• Platform’s Role: We will review disputes but do not guarantee resolution. We may provide warnings or take action against accounts involved in verified violations of our Terms.
• Stripe Disputes: Payment-related disputes are subject to Stripe’s policies.

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not responsible for the actions, quality of work, or harm caused by Cleaners or Clients.
• We are not liable for any loss, damages, or injuries arising from the use of the Platform or services arranged through it.
• Our liability is limited to the fees we collect for using our Platform.

9. Indemnity

You agree to indemnify and hold harmless findacleaner.net, its directors, employees, and affiliates from any claims, damages, or losses arising from:

• Your use of the Platform.
• Your breach of these Terms.
• Disputes or issues with other users.

10. Termination

We reserve the right to suspend or terminate your access to the Platform at our discretion if we believe you’ve violated these Terms or engaged in misconduct.

11. Privacy

Your use of our Platform is governed by our Privacy Policy

12. Changes to These Terms

We may update these Terms at any time. Updates will be posted on the Platform with a revised effective date. Continued use after updates constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Your Jurisdiction. Any disputes will be resolved in the courts of Your Jurisdiction.
